2021 Solar Panel Giveaway Competition

The Promoter of this Competition is Voltora Industries Pty Ltd ABN 53 606 804 219 of 108-109/193 South Pine Road, Brendale 4500 (Promoter or Voltora Industries).

By participating in the 2021 Solar Panel Giveaway Competition (Promotion or Competition), each Entrant unconditionally accepts and agrees to comply with and abide by these Terms and Conditions (Terms) and the decisions of the Promoter, which shall be final and binding in all respects. Promoter is responsible for the collection, submission or processing of Entries and the overall administration of the Competition. The Promoter in its sole and absolute discretion may refuse to award any prize to any entrant who fails to comply with these Terms and Conditions.

Entrants should look solely to Promoter with any questions, comments or problems related to the Competition. Promoter may be reached by email at [email protected] during the Promotion Period.

No purchase necessary to enter or win. Making a purchase or payment of any kind will not increase your chances of winning. Void where prohibited or restricted by law.

PROMOTION PERIOD

  1. The 2021 Solar Panel Giveaway Competition (Promotion) begins on 7.00am AEST on 1st May 2021 and ends at 11.59pm AEST on 31st May 2021. (the Promotion Period).

ELIGIBILITY

  1. The Competition is open to residents of Queensland, with a Queensland residential street address who:
    1. are 18 years old or over;
    2. is not a company, business or organisation of any description;
    3. own a property (Property must be registered in the Entrants name). Proof of ownership of the property maybe required.
  2. Promoter, and their respective parents, subsidiaries, affiliates, distributors, retailers, sales representatives, advertising and promotion agencies and each of their respective officers, directors and employees (the Promotion Entities), are ineligible to enter the Competition or win a prize. Household Members and Immediate Family Members of such individuals are also not eligible to enter or win. “Household Members” shall mean those people who share the same residence at least three months a year. “Immediate Family Members” shall mean parents, step-parents, legal guardians, children, step-children, siblings, step-siblings, or spouses.
  3. This Competition is subject to all applicable federal, state and local laws and regulations and is void where prohibited or restricted by law.
  4. The Promoter is responsible for determining whether a person is an Eligible Entrant in its sole and absolute discretion.

PRIZE

  1. The Competition is for the following prize which the winner will receive:
    • 18 x Trina 370w panels,
    • 1 x Sungrow 5kw inverter
    • 1 x standard installation
    • 5 year warranty

The prize in total has an approximate retail value or “ARV” of $5000.

  1. Only one prize per person and per household will be awarded. Prizes cannot be transferred, redeemed for cash or substituted by winner. Promoter reserves the right in its sole and absolute discretion to award a substitute prize of equal or greater value if a prize described in these Terms is unavailable or cannot be awarded, in whole or in part, for any reason.
  2. The ARV of the prize represents Promoter’s good faith determination. That determination is final and binding and cannot be appealed. If the actual value of the prize turns out to be less than the stated ARV, the difference will not be awarded in cash.
  3. Promoter makes no representation or warranty concerning the appearance, safety or performance of any prize awarded. Restrictions, conditions, and limitations may apply. Promoter will not replace any lost or stolen prize items.
  4. This Competition is open to legal residents of Queensland who own a property and the Prize will only be awarded and/or delivered to addresses within said locations. All federal, state and/or local taxes, fees, and surcharges are the sole responsibility of the prize winner. Failure to comply with the Terms will result in forfeiture of the prize.

HOW TO ENTER

  1. Participants can enter the Competition during the Promotion Period online by visiting the relevant promotional post, which can be found on the following website at https://www.voltoraindustries.com.au/2021-solar-panel-giveaway-promotion/.
  2. Automated or robotic Entries submitted by individuals or organizations will be disqualified. Internet entry must be made by the Entrant.
  3. Any attempt by Entrant to obtain more than the stated number of Entries by using multiple/different email addresses, identities, registrations, logins or any other methods, including, but not limited to, commercial contest/Competition subscription notification and/or entering services, will void Entrant’s Entries and that Entrant may be disqualified.
  4. Any cost associated with accessing the internet is the entrant’s responsibility and is dependent on the Internet service provider used.
  5. Only one entry per household will be accepted.
  6. Final eligibility for the award of any prize is subject to eligibility verification as set forth below. All Entries must be posted by the end of the Promotion Period in order to participate.    

WINNER SELECTION

  1. The Winner of the Competition will be selected in a random drawing from among all eligible Entries received throughout the Promotion Period. The random drawing will be conducted between 24 – 72 hours after the Promotion Period by Promoter or its designated representatives, whose decisions are final. Odds of winning will vary depending on the number of eligible Entries received.

WINNER NOTIFICATION

  1. Winner will be notified by PM (private message) through Facebook (or email) approximately 24 hours after the random drawing. Potential Winner must accept a prize by email as directed by Promoter within 14 days of notification. Promoter is not responsible for any delay or failure to receive notification for any reason, including inactive email account(s), technical difficulties associated therewith, or Winner’s failure to adequately monitor any email account.
  2. Any winner notification not responded to or returned as undeliverable may result in prize forfeiture. The potential prize winner may be required to sign and return an affidavit of eligibility and release of liability. No substitution or transfer of a prize is permitted except by Promoter.

PRIVACY

  1. Any personal information supplied by you will be subject to the privacy policy of the Promoter posted at https://www.voltoraindustries.com.au/privacy-policy/. By entering the Competition, you grant Promoter permission to share your email address and any other personally identifiable information in a publicly available Winners’ list.

GENERAL CONDITIONS

  1. As a condition of entering this promotion, each entrant licences the Promoter to use their entry in any media for an unlimited period for any reason including but not limited to future promotional, marketing or publicity purposes.  Entrants consent to any use of their entry which may otherwise infringe their moral rights pursuant to the Copyright Act 1968 (Cth).
  2. Entrants consent to the Promoter using their name, likeness and image in the event that they are a winner (including photograph, film and/or recording of the same) in any media for an unlimited period without remuneration for the purpose of promoting this promotion (including any outcome), and promoting any products manufactured, distributed and/or supplied by the Promoter.
  3. The Promoter collects personal information in order to conduct the promotion. The Promoter may, for an indefinite period, unless otherwise advised, use the information for promotional, marketing, publicity, research and profiling purposes, including sending electronic messages or telephoning the entrant. Entrants should direct any request to opt-out, access, update or correct information to the Promoter. All entries become the property of the Promoter.

ASSUMPTIONS AND CONDITIONS

  1. Panels are to be installed flat to roof (no tilt frames).
  2. Panel layout to be installed onto 2 roof faces only.
  3. Switchboard is compliant to current The Queensland Electricity Connection and Metering Manual (QECMM) requirements.
  4. Small-scale technology certificates (STCs) are fully assigned to Voltora on the completion of the installation.
  5. Metering charges (if applicable) are excluded and will be charged by the energy retailer on the power bill.

 LIMITATION OF LIABILITY

  1. Nothing in these Terms and Conditions limits, excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act, as well as any other implied warranties under the ASIC Act or similar consumer protection laws in the State and Territories of Australia (“Non-Excludable Guarantees”). Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the promotion.
  2. Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) is not responsible for and excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any theft, unauthorised access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in prize value to that stated in these Terms and Conditions; (e) any tax liability incurred by a winner or entrant; or (g) taking of or participation in the prize.
  3. If, for any reason, the Competition is not capable of running as planned for reasons which may include without limitation, infection by computer virus, tampering, unauthorized intervention, fraud, technical failures, or any other causes which may corrupt or affect the administration, security, fairness, integrity or proper conduct of this Competition, the Promoter reserves the right at its sole discretion to cancel, terminate, modify or suspend the Competition in whole or in part. In such event, Promoter shall immediately suspend all drawings and prize awards, and Promoter reserves the right to award any remaining prizes (up to the total ARV as set forth in these Terms) in a manner deemed fair and equitable by Promoter. Promoter and Released Parties shall not have any further liability to any participant in connection with the Competition.

  1. Entrants understand that they are providing their information to the Promoter and not to Facebook or Instagram. The information an entrant provides will only be used for the purposes outlined in these Terms and Conditions. Any questions, comments or complaints about this promotion must be directed to the Promoter and not to Facebook or Instagram. Facebook and Instagram will not be liable for any loss or damage or personal injury which is suffered or sustained by an entrant, as a result of participating in the promotion (including taking/use of a prize), except for any liability which cannot be excluded by law.

  1. Requests for the name of the winner must be received no later than Sunday 13 June 2021 after the Promotion Period has ended.   2. These Terms and Conditions are to be interpreted in accordance with the laws of the State of Queensland and all parties submit to the non-exclusive jurisdiction of the Courts of that State.
